Chief Public Defender

The Canyon County Board of Commissioners is in the process of creating an “in-house” Department of the Public Defender, which shall serve as the Canyon County Office of Public Defender as contemplated by Idaho law.  The Department will be responsible for providing legal services to indigent persons in criminal and civil matters in which the state or federal Constitutions, state statute or case law require the appointment of counsel for any person who cannot afford to retain counsel.  The Department will provide representation in criminal, delinquency, child protection, mental health, civil commitment, and contempt cases, as well as post-sentencing motions and post-conviction cases related to those matters.
 
The Board seeks applications for the position of Chief Public Defender.  The Public Defender Department will provide legal services to indigent adults and juveniles facing criminal charges.  The Department’s offices will be located in the County’s Administration Building in Caldwell, Idaho.  This position will provide representation in district and magistrate court, as well as other specialized units including problem-solving courts.  The staff will consist of attorney and support staff positions.  The Department will also utilize private attorneys to provide criminal defense representation in conflict cases.  Oversight of those attorneys will be provided by the Chief Public Defender in compliance with the County personnel manual.
 
The Chief Public Defender will report to the Board and be expected to develop and implement department fiscal, operational, and legislative policies.  The Chief Public Defender will manage the operations of the Department and provide guidance to the County Commissioners on matters relating to public legal defense, including the creation of an Indigent Defense Advisory Commission for Canyon County.  The Chief Public Defender will be selected for appointment by the Board of County Commissioners from a panel of candidates designated by a committee of lawyers appointed by the administrative district judge of Idaho’s Third Judicial District.  
 
The Chief Public Defender will serve appointed terms of not more than four years each, staggered against the four-year terms of the Elected Prosecuting Attorney, with early termination for cause and pursuant to a Canyon County Public Defender Ordinance to be adopted in the summer of 2014.
